I-9 Compliance & Audits

We counsel employers large and small on I-9 compliance issues to ensure that their workforce is verified and legally authorized to work in the United States.  Our team conducts affirmative audits to mitigate liability and fines in the event of an Immigration and Customs Enforcement (ICE) audit and to suggest improved policies and practices. Affirmative audits can be conducted onsite or virtually and can involve a full review of all I-9s or a sample set. In addition, we handle defensive I-9 audits from the issuance of a Notice of Inspection through settlement with ICE.   As changes are made to provisions regarding allowable virtual production and electronic storage of I-9s, our team advises clients on benefits and risks of adopting new methods.
